Terms of service
These terms cover Tellseed, run by Miguel Sanchez, a sole trader in the United Kingdom. Using the hosted service means agreeing to them. If you run Tellseed on your own server instead, only the licence in the source repository applies, and none of this does.

What the service is
Tellseed collects written answers from people you invite. You build a campaign, a person approves the exact version of it, you share a link, and the people you invited type answers. You review those answers and export them. We store what they typed, exactly as typed, and give it back to you.
We do not write answers, generate data, or check that what your contributors say is true. The judgement about what is worth keeping is yours, which is why review exists.
Your data is yours
We claim no licence over anything you or your contributors put into Tellseed.
We store it, show it back to you, and hand it over when you export. We do not use it to train anything, we do not sell it, and we do not show it to anyone but the people you give links to.
You can export everything at any time, in a documented format, without asking us. If you leave, export first, then ask us to delete the workspace.
What you are responsible for
You decide who to invite and what to ask them. That means you are responsible for having a lawful basis to collect what you collect, for telling contributors what their answers are for, and for honouring what you told them. If your contributors are in a place with data protection law, you are the controller of their answers and we are your processor.
- Do not collect answers from people who have not agreed to give them, gather special category data without a lawful basis, or do anything illegal where you or your contributors are. We will end an account doing any of those.
- Look after your links. A contributor link is a password: anyone holding it can answer. An owner link can do everything you can. Keep them somewhere safe and revoke them when they leak.
What we are responsible for
Running the service, keeping your data where we said we keep it, backing it up nightly, and telling you honestly when something breaks. When answering a support question means looking at your campaign, we mint a link the same way you would and it is recorded in your own audit trail, under support, for you to see and to revoke. There is no back door, and theprivacy page says so in more detail. We do not promise a particular uptime figure, because a single-operator service that promised one would be lying. We publish what is actually verified, and we do not claim more than that.
If we change something that affects what you already collected, or how, we tell you before it takes effect.
Plans and payment
Bring your own is free: you run it, we host nothing. Hosted Free is free within the limits published on the pricing page. Hosted Pro and Hosted Team are paid, monthly or yearly.
Payment goes through Paddle, who are the merchant of record: they take the card, charge the tax where you are, and issue the invoice. We never see a card number. What happens at each limit, how to cancel, and how refunds work are set out in thebilling terms, which form part of these terms.
No answer is ever refused because of a plan limit. Past the monthly limit we warn you; at three times it a campaign pauses itself and says so honestly to whoever is answering. Nothing already given is deleted or withheld for non-payment.
Ending it
You can stop at any time. Cancel a paid plan and it runs to the end of the period you paid for, then the workspace returns to Free with everything still in it.
We can end an account that is breaking these terms, that is not paying, or that is putting the service or other people at risk. Except where the law or an immediate risk says otherwise, we tell you first and give you a chance to export.
Liability
Tellseed is provided as it is. To the extent the law allows, we are not liable for lost profits, lost data beyond our backups, or indirect losses. Where we are liable, it is capped at what you paid us in the twelve months before the claim, or £100 if you paid nothing. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.
The rest
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If a part of them turns out to be unenforceable, the rest still stands. If we change them, this page changes and the date above changes with it; a change that materially affects a paid plan is announced by email before it applies.
